The Trespassing Response & Remedies Act (SB 448) is CalRHA’s sponsored bill that establishes a streamlined process for property owners to quickly remove trespassers (squatters) and reclaim their properties. Currently, property owners face costly, lengthy legal battles to remove unlawful occupants—even when those individuals have no right to be there.
 
SB 448 empowers law enforcement to take immediate action when property owners provide a sworn affidavit confirming unlawful entry. The bill also creates penalties for trespassers who falsify claims, protects lawful tenants, and shields disaster victims from losing their homes to squatters.

While these legislators may not represent where your properties are, as members of the Senate Public Safety Committee, your voice as multifamily operators that would be affected by this legislation is CRITICAL.

Explain to them the following talking points - 
  • I am calling with regard to Senate Bill 448, which will be heard in the Senate Public Safety Committee on April 8th.
  • Existing California laws make removing  trespassers a lengthy and costly process. States like New York, Pennsylvania, and Georgia have already implemented laws to address the trespassers crisis and it would benefit California to do the same.
  • I respectfully request your SUPPORT of Senate Bill 448 to protect victims of disasters, housing providers, and renters by implementing a balanced common-sense solution to trespassing that:
    • Provides law enforcement with the necessary tools to remove trespassers.
    • Provides reasonable remedies for homeowners and housing providers to reclaim their property without lengthy and costly legal proceedings that further strain our court system.
    • Safeguards lawful renters from wrongful evictions.
    • Ensures the availability of quality affordable housing for lawful renters.
