Costa Mesa Just Cause Eviction - October 17th

The city of Costa Mesa will be considering a Just Cause Eviction Ordinance for residential rental properties in the city. The stated goal is to protect the interests of residents from being unfairly evicted from their homes by property owners that may not comply with existing laws.

Over the past few months AAOC staff has been working with the council and the city to come up with solutions that better reflect the current state of Landlord/ Tenant Laws in California.

Back in 2019 the state implemented AB 1482 that significantly overhauled the laws surrounding rental property and implemented the original establishment of Just Cause Eviction law in California which protected tenants from a variety of no-fault evictions for a number of reasons.

This year the state passed SB 567 which established the legal framework around which certain types of no-fault evictions might occur - specifically addressing:

  • Evictions to significantly rehabilitate units or whole properties
  • Evictions to accommodate owners moving back into their own properties
  • Evictions to accommodate owners moving family members into their own properties

AAOC has worked with our coalition to help bring the reality of these regulations to the city in order to make sure that the proposal they brought forth was reflective of what existing law already suggests.

There were a few remaining discussion points that the city will consider at Tuesday's Council Meeting:

  • Should the property owners provide 1 or 2 months rental assistance to tenants required to move out?
    • AAOC has advocated that the city should comply with the state regulations and not create additional confusion on the issue for tenants or property owners.
  • Should the city work with the existing timelines established in SB 567 or should they create new standards?
    • Again AAOC has advocated to let the state laws be implemented prior to adjusting any regulations that could create confusion or issues in the rental housing industry.
